GENERAL POLICIES:

These are the policies, terms & conditions of DANG designs, Inc. hereafter referred to as “DANG designs”.

Estimates: DANG designs provides estimates that are binding contracts to both parties and fees are expressly limited to the items listed on the estimate. Any additional work requested in writing or verbally beyond the scope of the estimate may result in additional fees over the original estimate. A written change order will be issued for changes that result in more than 25% increase in overall project cost. For design work, all estimates include 3 rounds of revisions that may take place during the design process. Additional client revisions over the included 3 rounds of revisions may result in additional design time fees over the original estimate.

Estimate approvals may be signed/scanned/emailed, signed/faxed, sent in the subject or body of an email, or given verbally. Signed/scanned/emailed is the preferred method to submit your approval.

Estimates are good for 30 days and will have to be re-quoted after 30 days.

Printing: DANG design, Inc. will reprint any order that is below acceptable quality due to printer error. DANG designs, Inc. is not responsible for content errors after client approval of digital or physical proofs for printing and a reprint charge will apply. All claims must be made within 7 days of delivery and will require that all materials in question be returned. Payment for printing is due upon order placement.

Shipping time and rates vary depending on the service ordered. This does not include turnaround time on print projects, standard turnaround time for printing is 5 business days upon proof approval. DANG designs, Inc. will not be held responsible for delays in shipping caused by 3rd party shippers.

Unforeseen Technology Advances: Any technological advances from the time of estimate to website completion, such as Operating system (OS), browser, server and any/all technology advances that may effect the proper operation of a website as proposed in the estimate, cannot be known at time of estimate; and may result in extra fees to upgrade the website in order for the website to operate properly under any of said unforeseen technological advances at the time of original estimate.

Hosting: 99.9% Uptime Guarantee with DANG designs, Inc. hosting services. Use of hosting on 3rd party hosting will increase configuration and set up time. This fees for this time is undeterminable at time of estimate and will be added to the final invoice.

SEO: DANG designs will provide the best possible options at time of build to get your site submitted to and optimized for Google and other Search Engines, such as Yahoo & Bing, using 100% white hat (legal) means.

Client Supplied Content: Content that is to be placed in any advertising and marketing materials, including but not limited to website, print, and television graphics, is the be sent in a suitable format for placing. Extracting text from flattened sources will result in additional fees. Extracting and/or converting database content will result in additional fees.

Copyright and License: Upon payment in full, clients will have perpetual, nonexclusive, nontransferable license to use graphic, photographic, or video work produced by DANG DESIGNS. This does not apply to software/web applications. Software/web applications copyright and license will be outlined in contract. DANG designs retains all rights in relation to any & all custom code.

SMS / TEXT MESSAGING TERMS:

SMS Program Description: DANG designs, Inc. operates an SMS / text messaging program for customers and prospects who have explicitly opted in. Through this program, we send non-marketing messages including appointment confirmations, project status updates, scheduling changes, service-related notifications, and responses to client inquiries. With separate explicit consent, we also send marketing messages including special offers, discounts, new service announcements, and event invitations. By opting in, you agree to these SMS terms in addition to our general Terms & Conditions and Privacy Policy.

How to Opt-Out: You may opt out of receiving SMS messages from DANG designs, Inc. at any time by replying STOP to any message we send you. After replying STOP, you will receive one final confirmation message acknowledging your unsubscribe request, and no further messages will be sent unless you opt back in. Carrier Liability: Carriers, including but not limited to AT&T, T-Mobile, Verizon Wireless, Sprint, Boost, U.S. Cellular, and MetroPCS, are not liable for delayed or undelivered messages. T-Mobile is not liable for delayed or undelivered messages. Delivery of messages is subject to effective transmission from your wireless service provider/network operator and is outside of our control.

Age Restriction: Our SMS messaging program is not directed to, and we do not knowingly collect or solicit personal information from, individuals under the age of 18. By opting in to receive SMS messages from DANG designs, Inc., you represent that you are at least 18 years of age. If you are under 18, do not opt in to our SMS program. If we become aware that we have collected personal information or SMS opt-in consent from a person under 18, we will delete that information promptly.

Privacy: Your privacy is important to us.
